Terms of Service

These Terms of Service govern access to and use of cybaaspace websites, customer panel, VPS services, dedicated servers, IP resources, prepaid wallet balance, support, automation, APIs, and related infrastructure services. By creating an account, adding funds, ordering a service, or using the platform, you agree to these terms.
1. Definitions
Account means your cybaaspace customer account. Services means VPS, dedicated servers, IP addresses, network services, support, billing, and related platform features. Wallet balance means prepaid USD credit assigned to your account. Infrastructure includes virtual machines, dedicated hardware, nodes, network ports, IP pools, templates, and automation systems.
2. Account eligibility and responsibility
You must provide accurate account information and maintain access to your email address. You are responsible for all activity under your account, including services created by you, your employees, contractors, API tokens, or anyone using your credentials. You must keep passwords, API tokens, SSH keys, and panel sessions secure.
We may request additional verification when required for fraud prevention, abuse handling, payment review, legal compliance, or network security.
3. Prepaid wallet and billing model
cybaaspace operates on a prepaid billing model. You add balance to your wallet first, and services are ordered, renewed, upgraded, or extended using that wallet balance. Prices are displayed in USD unless stated otherwise.
Wallet balance is not a bank account, deposit account, or stored-value financial product. It is platform credit usable only for eligible cybaaspace services. Charges may include monthly service fees, setup fees, upgrade fees, add-ons, IP resources, restoration fees, manual work, or other products shown during checkout.
4. Crypto payments and third-party processors
Add-funds payments may be processed through third-party crypto payment providers. A payment is considered credited only after our system receives sufficient confirmation from the payment processor and marks the transaction as settled or completed. Blockchain delays, failed swaps, underpayments, overpayments, expired checkouts, and network fees are handled according to the payment processor flow and the transaction data received by cybaaspace.
You are responsible for sending payments to the correct checkout, asset, network, and amount. Funds sent outside the checkout instructions may be delayed, unrecoverable, or require manual review.
5. Orders, provisioning, and delivery
Orders may be provisioned automatically or manually depending on package type, available capacity, IP availability, payment status, fraud checks, template availability, and operational conditions. A service shown as pending or provisioning is not yet fully delivered. Power, reinstall, destroy, or upgrade actions may be unavailable during provisioning.
We may refuse, cancel, or delay orders that cannot be fulfilled safely, violate policy, fail verification, exceed capacity, or present abuse/fraud risk. If we cannot deliver an order after payment, we may return the amount to your wallet balance unless the payment provider or legal restrictions prevent this.
6. Renewals, suspension, and termination
Services renew from wallet balance on the due date. If wallet balance is insufficient, the service is suspended and kept for a limited retention period of 3 days unless a different period is shown in the panel or required by an agreement. After the retention period, the service may be queued for automatic deletion, hidden from the customer dashboard, IP addresses may be released, and data may be permanently erased.
Termination, destroy, reinstall, destructive downgrade, or deletion actions may permanently erase data. After termination or automatic expiry removal, IP addresses may be released, hostnames may be removed, and resources may be reallocated.
7. Upgrades, downgrades, and resource changes
Upgrades may be charged immediately from wallet balance. Downgrades may take effect immediately or at renewal depending on technical safety. Disk decreases are not guaranteed because shrinking disks can corrupt data. Some resource changes require restart, reinstall, migration, or manual approval.
8. IP address policy
IP addresses are assigned for use with active services and remain property of cybaaspace, upstream providers, or relevant registry holders. You receive a right to use assigned IPs while the related service is active and compliant. IPs may be changed, withdrawn, filtered, routed differently, or reassigned when required for operational, abuse, legal, routing, registry, or upstream reasons.
You may not announce, spoof, hijack, or use IP addresses not assigned to your service. cybaaspace may enforce allocated-IP usage through firewall rules, IP filtering, network controls, routing policy, or provider-level restrictions.
9. Acceptable use
You may not use services for spam, phishing, malware, botnets, credential theft, denial-of-service attacks, unauthorized scanning, brute force, exploitation, child sexual abuse material, terrorist content, illegal marketplaces, copyright infringement at scale, fraud, evasion, harassment, or activities that damage cybaaspace, customers, third parties, networks, or infrastructure.
High-risk services such as open proxies, mass mail, public VPN resale, crypto abuse, scraping, stress testing, Tor exits, bulletproof hosting, or similar use cases may require prior written approval and may be refused or terminated.
10. Abuse handling and emergency actions
We may suspend, rate-limit, null-route, firewall, isolate, snapshot, preserve, or terminate services involved in abuse, security incidents, legal complaints, unpaid billing, or urgent operational risk. We may share relevant technical data with upstream providers, law enforcement, security researchers, or affected parties when needed to investigate or stop abuse.
11. Backups and data responsibility
You are responsible for maintaining independent backups unless a separate managed backup service is explicitly purchased and active. cybaaspace is not responsible for data loss caused by customer actions, reinstall, destroy, termination, compromise, software errors, abuse intervention, or infrastructure failure beyond any mandatory legal requirement.
12. Support scope
Standard support covers platform access, billing, provisioning, network reachability, and infrastructure-level issues. Unless explicitly agreed, support does not include operating system administration, software debugging, application security, data recovery, custom firewall rules, mail reputation cleanup, or managed server work.
13. Service levels and maintenance
We aim to operate reliable infrastructure, but maintenance, emergency work, upstream outages, hardware failures, routing issues, DDoS events, software bugs, and force majeure may affect availability. Planned maintenance may be announced through the panel, status page, email, or ticket system when practical.
14. Security
You must secure your instances, patch software, configure firewalls, rotate credentials, and remove compromised systems. We may reset credentials, disable access, force reinstall, or require remediation if a service threatens platform or network security.
15. Refunds
Because services are prepaid and provisioned using allocated compute, network, hardware, and IP resources, refunds are not guaranteed unless required by law or explicitly approved. Setup fees, crypto network fees, abuse-related suspensions, completed billing periods, manual work, and consumed resources are generally non-refundable.
16. Limitation of liability
To the maximum extent permitted by law, cybaaspace is not liable for indirect damages, lost profits, lost revenue, reputational harm, data loss, business interruption, or consequential damages. Our aggregate liability for a claim is limited to the amount paid for the affected service during the one-month period before the event giving rise to the claim.
17. Changes to these terms
We may update these terms to reflect operational, legal, security, billing, or product changes. Continued use after publication means you accept the updated terms. Material changes may be announced through the website, panel, email, or support system.
